We are HeartCart, heartcart.co, and heart.art (“Company”, “we”, “us”, “our”). We operate heartcart.co and any other related products and services.
These legal terms constitute a legally binding agreement made between you and HeartCart. You agree that by accessing and using our services, you agree to these terms of use. If you do not agree to these terms of use, then you’re prohibited from using our services and must stop using HeartCart immediately.
Our intellectual property
HeartCart owns the rights to our services including the source code, databases, functionality, software etc. Our content is protected by copyright and trademark laws in the United States and around the world. Any breach of these intellectual property rights will constitute a material breach of this agreement and your right to use our services will terminate immediately.
Your submissions to us
By sending us any data (for example: support email or profile image upload), you agree that we will own this submission and may use it for any lawful purpose without acknowledgement or compensation to you.
You are responsible for what you post or upload to our platform(s). When you send a submission to our service you agree that you (1) will not post, send, publish, or upload anything that is hateful, defamatory, obscene, abusive, discriminatory, threatening, misleading, false, harmful, or illegal; (2) have all the proper rights to the materials in your submission; (3) are not engaging in prohibited activities detailed below.
Prohibited activities on HearCart:
- Attempt to mine for data or content without explicit written permission from us
- Trick, mislead, or harass other users
- Engage in fraudulent activity
- Circumvent or attempt to disable security features without written permission from us
- Engage in automated use of our services
- Impersonate another person
- Upload or transmit any illicit materials
- Copy or adapt our services software
- Creating additional accounts for the purpose of continuing to participate in prohibited activities on our platform(s)
- Money laundering
You are solely responsible for your submissions and you expressly agree to reimburse us for any and all losses that we may suffer due to your breach of this section, third-party intellectual rights, or applicable law.
Termination
We reserve the right to terminate your access to our services without warning should you violate these terms of use. If your account is terminated or suspended for any reason, you are explicitly prohibited from creating another account.
Dispute Resolution
Any dispute, claim, or controversy arising out of or relating to these Terms of Service or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be governed by the laws of North Carolina.
Arbitration Provider
Any such dispute shall be submitted to arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted online through a platform designated by the AAA.
Number of Arbitrators
The arbitration shall be conducted by a single arbitrator appointed in accordance with the rules of the AAA.
Exclusions
Notwithstanding the foregoing, disputes concerning small claims (as defined by applicable law) and disputes relating to intellectual property rights shall not be subject to arbitration and shall instead be exclusively resolved by the appropriate court within Wake County, North Carolina.
Changes to these terms
HeartCart may change these terms of service without notice. We may attempt to notify our users via email and/or an announcement on the website. We recommend that you review this policy periodically and your continued use of our services implies your acknowledgment of our latest terms of use updates and your agreement to follow our terms of use.
